These Terms govern your use of the YARD website and the Recovery Assessment service currently offered by YARD ("we", "us"). By using the website or submitting a stock list you agree to these Terms. They are intended to be reviewed by a solicitor prior to full marketplace launch.
1. The service today
YARD currently provides: (i) an informational website; (ii) a stock upload form; (iii) a professionally reviewed Recovery Assessment prepared by the YARD Recovery Team; and (iv) an Early Access register for the upcoming YARD marketplace. The marketplace itself is not yet live.
2. Eligibility
The YARD service is intended for use by UK businesses in the construction, merchant, manufacturing and supplier industries. You confirm you are authorised to submit information on behalf of your company.
3. Stock uploads
You retain ownership of any stock list, product data and files you upload. You grant YARD a limited, non-exclusive licence to use that information solely to prepare and deliver your Recovery Assessment and to communicate with you about it. Nothing is listed, published or shared publicly without your explicit prior approval.
4. Recovery Assessment
The Recovery Assessment is a professionally reviewed estimate based on the information you provide and current market conditions. It is indicative and does not constitute a firm offer to buy, sell or broker stock, a valuation for accounting purposes, or financial advice.
5. Early Access
Registering for Early Access adds you to a priority list for onboarding when the YARD marketplace opens. It does not create any obligation on you to buy or sell, nor any binding commitment on YARD regarding launch dates, features or pricing.
6. Acceptable use
You must not use the YARD website to (a) submit unlawful, misleading or infringing content; (b) upload stock you have no right to represent; or (c) attempt to disrupt, reverse engineer or gain unauthorised access to the service.
7. Fees
Submitting a stock list and receiving a Recovery Assessment is free of charge during Early Access. YARD may introduce paid services in future — you will be told before any charge applies to you.
8. Liability
The website and Recovery Assessment are provided on a reasonable endeavours basis. To the fullest extent permitted by law, YARD is not liable for indirect or consequential loss, lost profit or lost business arising from your use of the service. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.
9. Changes
We may update these Terms as YARD evolves. Continued use of the website after an update constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
